B-Drink Platform

1. Acceptance of Terms

By downloading, installing, accessing, or using the B-Drink mobile application, website, or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and B-Drink ("Company," "we," "us," or "our"). We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Eligibility — Age Requirement (18+)

You must be at least 18 years of age to use the Service. By creating an account or using B-Drink, you represent and warrant that you are at least 18 years old. B-Drink is a social platform associated with beverage and nightlife culture. We do not permit minors to access or use the Service under any circumstances.

If we discover or have reason to believe that a User is under 18 years of age, we reserve the right to immediately suspend or terminate their account without notice. B-Drink shall not be held liable for any consequences arising from a minor's unauthorized use of the Service.

3. Account Registration & Security

3.1 Account Creation

To use B-Drink, you must create an account using a valid email address and password, or through third-party authentication providers (Google Sign-In, Apple Sign-In). You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify B-Drink of any unauthorized use of your account. B-Drink shall not be liable for any loss or damage arising from your failure to secure your account.

3.3 One Account Per Person

Each User may maintain only one active account. Creating multiple accounts for deceptive, abusive, or fraudulent purposes is strictly prohibited and grounds for immediate termination.

4. Description of Service

B-Drink is a social platform that enables Users to discover, create, and participate in social events. The Service includes:

  • Event Discovery & Creation: Browse and create social events across categories (Craft Beer, Wine, Cocktail, Coffee, Rooftop, and others)
  • Event Chat: Group messaging linked to specific events for participant communication
  • User Profiles: Public profiles with display name, profile photo, and description
  • Location Services: GPS-based event discovery and distance calculations via Google Maps
  • Subscription Tiers: Free, Premium, Platinum, and Loyalist tiers with varying feature access and quotas
  • Favorites & Sharing: Save events and share via deep links
  • Reporting System: Report inappropriate content or users

5. Subscription & Payment Terms

5.1 Subscription Tiers

B-Drink offers subscription-based premium features. Subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android). By subscribing, you also agree to the respective app store's terms and conditions.

5.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Cancellation must be done through your device's app store settings.

5.3 No Refunds

All subscription payments are final and non-refundable, except as required by applicable law or the policies of Apple or Google. B-Drink does not process payments directly and has no ability to issue refunds — refund requests must be directed to the Apple App Store or Google Play Store.

5.3.1 Refund Request Window (In-App)

In-app cancellation flow may mark a subscription as refund-eligible only within 48 hours from the original purchase time. After 48 hours, cancellation remains available but refund-eligibility is no longer shown in-app.

5.4 Price Changes

B-Drink reserves the right to change subscription prices at any time. Price changes will not affect your current billing period but will apply upon renewal.

5.5 Grace Period

If a subscription payment fails, a grace period may apply during which your premium features remain accessible. If payment is not resolved within the grace period, your account will revert to the free tier.

6. Events — User Responsibility & Platform Disclaimer

6.1 Event Creation

Users who create events are solely responsible for the accuracy of event information (title, description, location, time), the safety and legality of the event, and the conduct of participants.

6.2 Platform as Facilitator Only

B-Drink is a technology platform that connects people. B-Drink does NOT organize, host, sponsor, endorse, or supervise any events. We are merely a facilitator that provides tools for Users to coordinate social gatherings.

6.3 No Liability for Events

B-Drink shall NOT be liable for any incidents, injuries, damages, losses, disputes, altercations, thefts, assaults, or any other occurrences that take place at, during, before, or after any event. Users attend events entirely at their own risk.

6.4 Passcode-Protected & Private Events

Some events may be protected by passcodes or set as private. B-Drink is not responsible for unauthorized access to events or the actions of individuals who gain access through shared passcodes.

7. User Content & Conduct

7.1 User-Generated Content

Users are solely responsible for all content they post, upload, or share, including profile information, event details, chat messages, and images. By posting content, you grant B-Drink a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content.

7.2 Prohibited Content & Conduct

You agree NOT to:

  • Post false, misleading, defamatory, or fraudulent content
  • Harass, threaten, bully, stalk, or intimidate other Users
  • Share sexually explicit, violent, hateful, or illegal content
  • Impersonate other individuals or entities
  • Engage in spam, phishing, or unsolicited advertising
  • Attempt to reverse-engineer, hack, or compromise the Service
  • Use the Service for any commercial purpose without authorization
  • Collect or harvest other Users' personal data without consent
  • Circumvent security measures, tier restrictions, or quotas

7.3 Content Removal

B-Drink reserves the right to remove any content at its sole discretion, without notice or explanation. We are not obligated to monitor content but may do so to enforce these Terms.

8. Chat & Messaging

8.1 Event Group Chats

Chat functionality is provided for communication between event participants. Messages and images shared in chats are visible to all participants of that event.

8.2 No Private Messaging Guarantee

B-Drink does not guarantee the privacy or confidentiality of messages. Do not share sensitive personal information, financial details, passwords, or confidential data through the chat feature.

8.3 Chat Content

B-Drink is not responsible for the content of messages exchanged between Users. We do not actively monitor chat messages but reserve the right to review reported content.

9. Location Services

9.1 GPS & Location Data

B-Drink uses location services (via Google Maps and Google Places) to display nearby events and calculate distances. Location data is collected only when you grant permission through your device settings.

9.2 Location Accuracy

B-Drink does not guarantee the accuracy of location data, venue information, or distance calculations. You should independently verify event locations before attending.

10. Alcohol-Related Disclaimer

10.1 B-Drink Is NOT an Alcohol Seller

B-Drink does NOT sell, distribute, deliver, supply, or promote the sale of alcoholic beverages. B-Drink is a social platform for event discovery and coordination. Any alcohol consumption at events is entirely the decision and responsibility of individual Users.

10.2 Compliance with Local Laws

Users are solely responsible for complying with all applicable local, national, and international laws regarding the purchase, possession, and consumption of alcoholic beverages.

10.3 Responsible Consumption

B-Drink does not encourage or promote excessive or irresponsible alcohol consumption. Users acknowledge that they are solely responsible for their own actions and decisions regarding alcohol.

11. Prohibited Activities & Illegal Use

B-Drink strictly prohibits the use of the Service for any illegal, unlawful, or criminal activities, including but not limited to:

  • Drug trafficking, distribution, or solicitation
  • Gambling or illegal betting
  • Prostitution or solicitation of sexual services
  • Human trafficking
  • Sale of counterfeit or stolen goods
  • Money laundering
  • Any activity that violates local, national, or international law

B-Drink shall NOT be held liable for any illegal activities conducted by Users through or in connection with the Service. If we become aware of illegal activity, we may report it to law enforcement and cooperate fully with any investigation.

12. Fraud, Scam & User-to-User Disputes Disclaimer

B-Drink is NOT responsible for any fraud, scams, deception, misrepresentation, or criminal conduct committed by Users against other Users. This includes but is not limited to:

  • Financial scams or requests for money
  • Identity theft or impersonation
  • Fake events created for fraudulent purposes
  • Theft of personal property at events
  • Romance scams or catfishing
  • Phishing through chat messages
  • Any other deceptive or manipulative behavior

Users interact with other Users entirely at their own risk. B-Drink does not verify the identity, intentions, background, or criminal history of Users. We strongly recommend exercising caution when meeting people through the platform, never sharing financial information, and meeting in public, well-lit locations.

B-Drink shall NOT be liable for any damages arising from User-to-User interactions, whether occurring through the Service or at in-person events.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

B-Drink does not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Information provided by Users is accurate, reliable, or truthful
  • Events listed on the platform are safe, legal, or legitimate
  • Defects will be corrected in a timely manner
  • The Service is free of viruses or other harmful components

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, B-DRINK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM:

  • Your use of or inability to use the Service
  • Any conduct or content of any User or third party
  • Unauthorized access to or alteration of your data
  • Any events, meetups, or gatherings organized through the Service
  • Any third-party services, links, or integrations

IN NO EVENT SHALL B-DRINK'S TOTAL LIABILITY EXCEED THE GREATER OF THB 1,000 (ONE THOUSAND THAI BAHT) OR THE AMOUNT YOU HAVE PAID TO B-DRINK IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to defend, indemnify, and hold harmless B-Drink and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your User content
  • Your conduct at any event organized or discovered through the Service
  • Any illegal activity you engage in through or in connection with the Service

16. Third-Party Services & Links

The Service may integrate with or contain links to third-party services, including but not limited to:

  • Firebase (Google Cloud): Authentication, database, storage, analytics
  • Google Maps / Google Places: Location and venue services
  • Apple App Store / Google Play Store: Subscription and payment processing
  • Apple Sign-In / Google Sign-In: Third-party authentication

B-Drink is not responsible for the availability, accuracy, content, or practices of third-party services. Your use of such services is subject to their respective terms and privacy policies.

17. Intellectual Property

All intellectual property rights in the Service, including but not limited to trademarks, logos, designs, code, and documentation, are owned by B-Drink. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

User-generated content remains the property of the User who created it, subject to the license granted under Section 7.1.

18. Account Termination & Suspension

18.1 By B-Drink

We reserve the right to suspend or terminate your account at any time, for any reason, with or without notice, including but not limited to violations of these Terms, illegal activity, fraud, or abuse.

18.2 By You

You may delete your account at any time through the app settings. Upon deletion, your profile information will be removed, though some data may be retained as required by law or for legitimate business purposes.

18.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. B-Drink is not obligated to provide any refunds upon termination. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.

19. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Thailand.

20. Changes to Terms

B-Drink reserves the right to modify these Terms at any time. Material changes will be communicated through in-app notifications and may require re-consent. The "Last updated" date at the top of this document indicates when these Terms were last revised. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms.

21. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and B-Drink.

22. Force Majeure

B-Drink shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond B-Drink's reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, typhoons, pandemics, epidemics)
  • Acts of government, war, terrorism, civil unrest, or sanctions
  • Power outages, internet disruptions, or telecommunications failures
  • Failures or outages of third-party infrastructure providers, including Google Cloud, Firebase, Apple App Store, or Google Play Store
  • Cyberattacks, DDoS attacks, or security incidents beyond B-Drink's control
  • Labor disputes, strikes, or supply chain disruptions
  • Any other event beyond B-Drink's reasonable control

During any force majeure event, B-Drink's obligations shall be suspended for the duration of the event. B-Drink will use reasonable efforts to mitigate the impact and resume the Service as soon as practicable.

23. Account Deletion

You may request deletion of your account at any time through the Settings > Delete Account feature in the App. Upon submitting a deletion request:

  • Grace Period: Your account will be scheduled for deletion after a 30-day grace period. During this period, your account will be deactivated and your profile will no longer be visible to other users.
  • Cancellation: You may cancel your deletion request at any time during the 30-day grace period by logging back in and selecting "Cancel Deletion" in Settings.
  • Permanent Deletion: After the grace period expires, the following data will be permanently deleted: profile information, event data you created, chat messages, uploaded images (profile photos, event images, chat images), and notification history.
  • Retained Data: Certain data may be retained for legal, regulatory, or safety reasons, including: consent records, report records (both filed by and against you), anonymized analytics data, and transaction/subscription records as required by applicable tax and financial laws.
  • Active Subscriptions: If you have an active subscription, it will be cancelled upon account deletion. No refund will be provided for the remaining subscription period. You must separately cancel your subscription through Apple App Store or Google Play Store.
  • Processing Time: Permanent deletion of all data may take up to 90 days from the end of the grace period to fully propagate across all backup and archival systems.

Warning: Account deletion is irreversible after the grace period. All your data, events, and connections will be permanently lost. Please ensure you have backed up any data you wish to keep before requesting deletion.

24. User Reporting & Blocking

B-Drink provides tools for maintaining a safe community. You may report or block other users through the App.

24.1 Reporting Users

  • You may report a user for the following reasons: harassment, spam, fraud, inappropriate content, suspected underage use, or other violations of these Terms.
  • Reports may include a description and up to 3 evidence images.
  • B-Drink will review reports and take appropriate action at its sole discretion, which may include: a warning to the reported user, temporary suspension, permanent account ban, or referral to law enforcement.
  • Filing false or malicious reports is a violation of these Terms and may result in action against the reporting user.

24.2 Blocking Users

  • You may block any user at any time through their profile page.
  • When you block a user: their events will be hidden from your feed, your events will be hidden from them, they will be removed from shared event chats with you, and they cannot join events you create.
  • You may unblock a user at any time through Settings > Blocked Users.
  • Blocking is mutual — both parties will be unable to interact with each other on the platform.

24.3 Enforcement & Appeals

  • B-Drink enforces a graduated response system: first violation may result in a warning, repeated violations may result in temporary suspension (7–30 days), and severe or repeated offenses may result in permanent ban.
  • If your account is suspended or banned, you may appeal the decision by contacting appeals@b-drink.com within 14 days of the action.
  • B-Drink's decision on appeals is final and at its sole discretion.
